General terms and conditions of business
Survival Skills punktCH
I. General
The following General Terms and Conditions apply exclusively to the business relationship between Survival Skills (hereinafter referred to as "Organizer") and its customers (hereinafter referred to collectively as "Customers" or "Participants"), in the version valid at the time of the order or conclusion of the contractual relationship between the Organizer and the respective Customer. The Organizer does not recognize any deviating regulations unless they have been expressly agreed to in writing. The Organizer's services include the organization and execution of courses, seminars, workshops, coaching sessions, and similar services (hereinafter collectively referred to as "Courses"), all of which are provided on the basis of these General Terms and Conditions, which thus form an integral part of the contract and are therefore also binding for the Customers. Any references by the Customers to deviating terms and conditions in the order placed with the Organizer or in other documents are deemed invalid.
II. Organization and Implementation of the Courses
The courses offered are conducted as in-person or online events, as described in the course description published on the website www.survival-skills.ch. If in-person events are not possible for legal reasons, a transfer to an equivalent online event is considered agreed upon.
III. Registration
[1.] Registration for the offered courses is done in writing via a webshop order on the website www.survival-skills.ch, by email to info@survival-skills.ch, or by telephone using the telephone number listed on the aforementioned website. Registrations will be processed in the order they are received. The organizer reserves the right to refuse participants, particularly if the maximum number of participants has already been reached.
[2.] Contracts are only concluded upon written order confirmation. Oral agreements or side agreements only become valid upon written confirmation.
[3.] Participation in Survival Skills courses before the customer reaches the age of 18 is only possible with a written declaration of consent from the parent(s) or guardian(s).
IV. Discounts
Any discounts or rebates cannot be added together; that is, the highest discount applies per course or date.
V. Right of withdrawal or cancellation for consumers
Customers have the right to withdraw from this contract within 14 days without giving any reason, provided that a contract has been concluded via distance selling (e.g. via the webshop, by e-mail or by telephone).
As of October 2023
The cancellation period is 14 days from the date of conclusion of the contract.
To exercise the right of withdrawal, customers must inform the organizer of their decision to withdraw from the contract by means of a clear statement (e.g., a letter sent by post or email). The organizer will immediately confirm receipt of such a withdrawal. To meet the withdrawal deadline, it is sufficient for customers to send their notification of withdrawal before the withdrawal period has expired.
Consequences of the revocation:
If customers cancel this contract, the organizer must reimburse all payments received from the customers without undue delay and at the latest within 14 days from the day on which the organizer received notification of the cancellation of the contract.
For refunds, the organizer will use the same payment method that customers used for the original transaction, unless expressly agreed otherwise with the customers. Under no circumstances will customers be charged a fee for the refund.
Customers are not entitled to a right of withdrawal for courses that begin within the 14-day withdrawal period following the conclusion of the contract.
VI. Cancellations and Rebookings
[1.] If a registration is cancelled up to 14 days before the start of the course, written notification to the organizer is required, who will issue a confirmation. The processing fee for such a cancellation is 20% of the course fee. If the registration is cancelled up to 14 days before the start of the seminar and transferred to another course, the existing invoice will be credited to the other course; in this case, no processing fee will be charged.
[2.] If a registration is cancelled 13 to 7 days before the course begins, 50% of the course fee will be charged. If the registration is transferred to another course during this period, the original invoice remains valid and will be credited towards the other course. The processing fee for such a cancellation and transfer is 20% of the course fee.
[3.] If a registration is cancelled 6 to 0 days before the start of the seminar, 100% of the course fee will be charged.
[4.] In the event of a cancellation, a substitute participant may be nominated for the course with the organizer's written consent. Any cancellation fees will be waived upon payment of the course fee by the substitute participant. The original participant will be charged a processing fee of 20% of the course fee.
[5.] In the event of non-attendance without cancellation or termination of a course by the participant, the full course fee will be retained.
[6.] Booked private lessons are binding. Cancellation up to 3 months before the start of the course is free of charge for the customer. After that, in the event of cancellation by the customer, 100% of the course fee will be charged in any case.
[7.] Separate cancellation policies apply to individual events, which will be announced at the time of booking.
[8.] The organizer recommends taking out cancellation insurance.
[9.] The organizer may withdraw from the contract if the course fee is not paid on time.
VII. Dates, postponements, rescheduling and cancellations
The start and end dates of each course can be found on the website www.survival-skills.ch and in the documents published by the organizer. The organizer reserves the right, in exceptional cases, to make necessary changes to the course program, dates, any seminar speakers (coaches, etc.), and the course location, as well as to shorten, cancel, or postpone certain courses if there are too few participants. Participants have no claim to compensation as a result.
As of October 2023
Reimbursement of costs for hotel, travel, etc.). Illness of the organizer or any seminar presenters (coaches, etc.), as well as all cases of force majeure, entitle the organizer to cancel courses up to the point of their commencement or to postpone the start of the course. The organizer has the right to change the course location, even repeatedly, within the event locations and their surroundings at any time, provided sufficient notice is given. The course duration specified by the organizer is based on an assumed average number of participants. Should this average number of participants not be reached, the organizer has the right to shorten the seminar duration accordingly without reducing the course fee.
VIII. Prices, Invoicing, Credits and Vouchers
[1.] All prices quoted are exclusive of applicable VAT, unless the organizer explicitly indicates that VAT is included. Unless otherwise agreed, the prices stated in the organizer's current published documents (e.g., website) shall apply; these will be invoiced upon registration and are due for payment no later than 3 weeks before the course begins, unless expressly agreed otherwise with the customer.
[2.] The organizer generally offers the following payment options:

[5.] Credit or vouchers can never be redeemed for cash.
IX. Payment, Taxes and Fees
[1.] The organizer's customers will receive invoices electronically or by post to the email or postal address they have provided. The customer is responsible for ensuring that all electronic invoices sent by the organizer can be properly delivered to the provided email address and that technical systems such as filters or firewalls are configured accordingly. Automated electronic replies to the organizer (e.g., out-of-office messages) cannot be considered and do not constitute valid delivery.
[2.] The customer must notify the organizer immediately in writing and in a legally valid manner of any changes to the email address to which the invoice is sent. Furthermore, invoices sent by the organizer to the email address last provided by the customer will be deemed delivered even if the customer has notified the organizer of a change to their email address.

X: External seminar events and disclaimer
[1.] The organizer also offers seminars abroad. For such courses, the organizer acts solely as the course provider, not as a tour operator and/or travel agent. The course instructor therefore assumes no liability or responsibility for any travel-related claims or claims arising in connection with the customers' travel activities. The organizer's offer is thus limited to the seminar itself. The customer travels to such courses abroad as a private individual.
[2.] The courses offered by the organizer include physical exercises and tasks. Customers participate in such exercises and tasks at their own risk and responsibility. The organizer's liability for any resulting damages is limited to gross negligence or intent.
XIII. Exclusion of Participants

XIV. Miscellaneous
[1.] Participation in the courses is at your own risk. The organizers recommend that you have up-to-date tetanus and tick-borne encephalitis vaccinations. For your own protection, you should obtain a medical certificate from your family doctor. Any special medical conditions and/or allergies must be reported to the organizers upon registration.
[2.] Any side agreements that change the scope of the contractual services require written confirmation.
[3.] The organizer reserves the right to change the course program at its own discretion, taking into account the interests of the participants, in the event of changes in the weather that make it impossible or significantly affect the execution of the planned course program.
[4.] Due to the constant exposure to the outdoors and the realistic nature of the training, the preparation of food and drinks does not always meet usual hygienic standards. Overnight stays are in self-built survival shelters. The course location generally does not have sanitary facilities.
[5.] The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity and enforceability of the other provisions.

[7.] The contractual relationship between the organizer and the customers, and these General Terms and Conditions, are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules of private international law. The competent court shall have jurisdiction over all legal disputes arising from the contractual relationship between the organizer and the customers or from these General Terms and Conditions.
[8.] Survival Skills reserves the right to change these Terms and Conditions at any time. It is the customer's responsibility to ensure they are aware of the applicable terms and conditions at the time of booking.
